Terminology

For the purposes of this Agreement (the "Agreement"), the Platform is referred to as "we", "us", or "our". Users and other visitors to the Platform are referred to as "you", "your", or "User". Together, "we" and "you" are collectively the "parties", and each individually is a "party".

Processing and Retention Periods for Personal Data

We will process and retain your personal data for as long as required by law, or for the period agreed with you at the time of collection.

Collaboration with law enforcement authorities for investigative purposes.

Generally, we retain your personal data for 18 months after you delete your account or if your account is deactivated due to misuse. This period allows for any reviews by financial institutions or investigations by authorities. If no such reviews or investigations occur, we will permanently delete your data after this timeframe.

This Agreement applies to all users trading on the Sterk Evolux Global website and mobile app (the 'Platform'). Users must comply with the terms and conditions of this Agreement and with all applicable laws and regulations governing personal data and privacy in their respective country or region.

Invocation

All references in this Agreement to codes, statutory decrees, or administrative regulations are to the most recently amended version, whether the amendment occurred before or after this Agreement was signed.

Headings

Headings in this Agreement are provided solely for convenience and must not be used to interpret the terms and conditions. Any reference to statements, terms, conditions, annexes, or schedules refers only to those contained in this Agreement.

Guidance on the Use of the Term 'Include'

In this Agreement, the term 'include' shall mean 'including, without limitation,' unless expressly stated otherwise.

Information Collected

By using the Platform, users consent to the Platform’s use of cookies to monitor activity on the Platform and to collect information including, without limitation, IP addresses, geolocation data, and other relevant details. For example, we may use video (including audio) recordings to verify the identities of P2P merchants and to serve as evidence in P2P order disputes. Additionally, facial video (including audio) may be used for Sterk Evolux identity verification on third-party platforms..

Limitation of Liability

Although the Platform implements technical and security safeguards to protect your information, we cannot guarantee that data sent over the internet is 100% secure. Therefore, we do not make any warranties about the security of the personal information you share, and we are not liable for any loss or damage resulting from unauthorized access to your personal data.

Updates to this Agreement

We may update this Agreement at any time. If we revise the Privacy Policy, we will notify you by posting the changes, including the new effective date and a summary of what has changed. In some cases, we may also send you a direct notice. Please review the Privacy Policy regularly. By continuing to use the Platform after changes take effect, you agree to the updated terms.

We will issue official announcements only via the verified contact details you have provided or by publishing them directly on the Platform. We are not liable for any losses arising from reliance on information obtained through other channels.
